1. General

These Terms & Conditions apply to the guided e-bike tours and private experiences offered by Iván Sánchez Rodríguez, trading as Easy Andalusia.

By making a booking, the customer agrees to these Terms & Conditions.

Easy Andalusia offers recreational and cultural guided e-bike experiences in and around Ronda, Málaga, Spain.

2. Bookings and Payment

Bookings are made through our online booking system or directly with Easy Andalusia.

The price shown at the time of booking is the price applicable to the selected tour or experience.

Payment is required to confirm the booking, unless otherwise agreed in writing.

A booking is only confirmed once payment has been successfully completed and a booking confirmation has been issued.

3. Minimum Number of Participants

A minimum of 2 participants is required for a guided tour to take place.

Individual bookings are welcome. However, if the minimum number of participants is not reached, Easy Andalusia may cancel the tour and the customer will receive a full refund or may choose to reschedule the booking to another available date.

Where possible, Easy Andalusia will inform the customer as soon as reasonably possible if the minimum number of participants has not been reached.

4. Cancellation by the Customer

Customers may cancel their booking 24 hours or more before the scheduled starting time for a full refund.

Cancellations made less than 24 hours before the scheduled starting time are non-refundable.

Failure to attend the tour without prior notice (no-show) is non-refundable.

If a booking is cancelled by the customer in accordance with these Terms & Conditions, any refund will be processed through the payment method used for the booking, subject to the processing procedures of the relevant payment provider or booking platform.

5. Cancellation or Changes by Easy Andalusia

Easy Andalusia reserves the right to cancel, postpone or modify a tour when necessary for safety reasons, including unsuitable weather conditions, unsafe road or route conditions, official restrictions, road closures or other circumstances beyond our reasonable control.

If Easy Andalusia cancels a tour, the customer may choose between:

• A full refund; or

• Rescheduling the tour to another available date.

If a tour needs to be modified for safety reasons, Easy Andalusia will inform the customer as soon as reasonably possible.

Easy Andalusia will make reasonable efforts to provide an alternative that is comparable to the original experience where possible.

Tours may operate in light rain and normal weather conditions where the route remains safe. Participants are expected to attend the tour in suitable clothing for the forecast conditions. Personal preference to cancel due to light rain or normal weather conditions does not constitute a cancellation by Easy Andalusia and is subject to the customer cancellation policy set out in Section 4.

6. Participant Requirements

Participants must be able to ride a bicycle confidently and safely.

There is no fixed minimum age. Children may participate provided they are tall enough to safely use the smallest available e-bike size (Size S) and meet all other participation requirements.

The final suitability of an e-bike for a participant may be assessed by the guide before the tour.

For insurance purposes, participants must meet the eligibility requirements established by the applicable accident insurance policy. The current accident insurance covers participants included in the corresponding registration record and does not cover persons over 69 years of age.

Participants must wear the helmet provided during the tour and follow all instructions given by the guide.

Easy Andalusia reserves the right to refuse participation if a person is unable to safely operate the e-bike, does not meet the applicable participation or insurance requirements, or does not follow the guide's instructions.

7. Safety and Responsible Riding

Participants are responsible for riding the e-bike safely, following the guide's instructions and complying with applicable traffic rules.

The tours are recreational and cultural experiences and are not intended as technical mountain-bike training, competition or adventure-sport activities.

Routes may include roads, asphalt surfaces and wide, well-maintained tracks, as well as normal changes in terrain and riding conditions.

Participants must inform the guide before the tour of any circumstance that may affect their ability to safely participate.

Participants must not ride under the influence of alcohol, drugs or any other substance that may impair their ability to operate the e-bike safely.

Easy Andalusia will not be responsible for incidents or damage caused by a participant's negligent, reckless, intentional or improper conduct, except where liability cannot legally be excluded or limited.

8. Equipment

An electric bicycle and helmet are provided as part of the tour.

Participants are responsible for using the equipment properly and following the guide's instructions regarding its use.

Participants must not intentionally misuse, modify or use the equipment in a manner contrary to the instructions provided.

Any damage caused by intentional misuse or reckless behaviour may be the responsibility of the participant, subject to applicable law.

Normal wear and tear and damage not caused by the participant will not be charged to the participant.

9. Insurance

Easy Andalusia maintains insurance applicable to the activity offered.

The current public liability insurance covers the civil liability associated with the activity described in the policy as “Organización y guiado de rutas recreativas en bicicleta”, with a limit of €300,000 per claim and €300,000 per victim, without a deductible, subject to the terms, conditions and exclusions of the policy.

Easy Andalusia also maintains collective accident insurance for participants in the declared activity of “Cicloturismo”. The accident policy covers accidents occurring during the declared activity for participants included in the corresponding registration record, subject to the terms, limits, conditions and exclusions of the policy.

Insurance coverage does not remove the participant's obligation to comply with these Terms & Conditions, the guide's safety instructions and applicable laws and regulations.

10. Personal Belongings

Participants are responsible for their personal belongings during the tour.

Easy Andalusia is not responsible for the loss, theft or damage of personal belongings except where legally required.

Participants are advised not to bring unnecessary valuables on the tour.

11. Private Experiences

Private experiences are arranged according to the customer's individual request.

A request for a private experience is not a confirmed booking.

After receiving a request, Easy Andalusia will assess the requested experience and provide a personalised proposal, including availability, itinerary and price.

The private experience is only confirmed once the customer accepts the proposal and completes the required payment or booking process.

Specific conditions may apply to individual private experiences and will be communicated to the customer before confirmation.

12. Photography and Media

During tours, photographs or videos may occasionally be taken for operational, documentary or promotional purposes.

Easy Andalusia will not use identifiable images of participants for promotional purposes where consent is legally required without obtaining the appropriate consent.

Customers who do not wish to appear in promotional photographs or videos may inform the guide before the tour.

Where consent is required, refusing consent will not affect the customer's ability to participate in the tour.

13. Force Majeure

Easy Andalusia shall not be held responsible for failure or delay in providing a service caused by circumstances beyond its reasonable control, including severe weather, natural events, road closures, official restrictions, strikes, accidents, public safety measures or other unforeseen circumstances affecting the safe operation of the tour.

Where possible, Easy Andalusia will offer an alternative date or a refund depending on the circumstances.

14. Limitation of Liability

Easy Andalusia shall be responsible for losses or damages to the extent required by applicable law.

Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited, including liability arising from death or personal injury caused by negligence where such limitation would be unlawful.

Participants remain responsible for their own conduct and for complying with the safety instructions provided by Easy Andalusia and its guide.

15. Applicable Law and Consumer Rights

These Terms & Conditions are governed by Spanish law.

Nothing in these Terms & Conditions affects any mandatory rights that consumers may have under applicable consumer protection legislation.

Any disputes shall be subject to the courts and jurisdiction applicable under Spanish law and, where mandatory consumer protection rules apply, to the jurisdiction provided by those rules.
